1. Acceptance of Terms

By downloading, accessing, or using Jam AI (the "App") and our associated website https://jamaiapp.com (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Jam AI is an AI-powered application that allows users to input text prompts and upload screenshots or images to generate personalized audio tracks and songs (the "Generated Content").

3. User Accounts

  • Eligibility: You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App.
  • Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content (Your Uploads)

You may submit text, images, and screenshots ("User Input") to the App.

  • Your Responsibility: You are solely responsible for the User Input you upload. You represent and warrant that you own or have the necessary licenses, rights, and permissions to use and upload this content.
  • Prohibited Content: You agree not to upload User Input that:
    • Contains personally identifiable information of others (e.g., social security numbers, private text conversations, financial data) without their consent.
    • Infringes on any third party’s copyright, trademark, or other intellectual property rights.
    • Is illegal, defamatory, harassing, abusive, obscene, or promotes violence or discrimination.
    • Contains Child Sexual Abuse Material (CSAM) or explicit nudity.

We reserve the right to block, review, or delete any User Input that violates these Terms or our policies.

5. Intellectual Property and Ownership

  • Your User Input: You retain all ownership rights to the original text and screenshots you upload to the App. You grant us a worldwide, non-exclusive, royalty-free license to host, process, and transmit your User Input solely for the purpose of operating the Service and generating your songs.
  • The Generated Songs: Jam AI owns the Generated Content. However, we grant you a non-exclusive, worldwide, royalty-free license to use, download, and share the generated songs for personal, non-commercial purposes.
  • Third-Party AI Services: You acknowledge that the Service utilizes third-party artificial intelligence providers to generate songs. Your rights to the Generated Content are subject to the terms and conditions of these third-party providers.

6. Prohibited Conduct

When using the Service, you agree not to:

  • Reverse engineer, decompile, or disassemble any aspect of the App.
  • Use automated systems, bots, or scraping tools to access the App or generate songs in bulk.
  • Attempt to bypass or circumvent any rate limits, paywalls, or security features.
  • Use the Service to generate deepfakes, impersonate others, or create misleading audio content.

7. Subscriptions and Payments

Certain features of the App may require a paid subscription or in-app purchases (e.g., purchasing "credits" or a Premium tier).

  • All payments are processed through the applicable app store (Apple App Store or Google Play Store) or our third-party payment processor.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Refunds are handled in accordance with the policies of the app store where the purchase was made.

8. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis.

We make no warranties, expressed or implied, regarding the accuracy, quality, or musical appeal of the Generated Content. Because the content is generated by AI, you may occasionally receive unexpected, inaccurate, or offensive results. We do not guarantee that the App will be error-free or uninterrupted.

9. Limitation of Liability

To the maximum extent permitted by law, Jam AI and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the service or the generated content. In no event shall our total liability exceed the amount you paid to us in the past 12 months.

10. Indemnification

You agree to indemnify, defend, and hold harmless Jam AI, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your User Input, or your violation of these Terms.

11. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We may also update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date or through an in-app notification. Your continued use of the App after changes are made constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in the State of Delaware.
